Third parties that use our software (white label)
We may provide Fourstarzz software to third parties for its use by such third parties under their brand (“white label”). In such cases we act as data processor for all collectible personal and non-personal data, and third party, who use our software under white label, is data controller for all such data. As a data processor we don't use any data in any way, collected by Fourstarzz software under white label, we only collect and store it.
Who Do We Collect Information About?
In order for us to provide the Services, we must collect information from active social media participants who may be engaged by businesses to endorse or advertise their product or services (“Influencers”), the people who are engaged with the Influencers (their “Audience”), and purchasers or other users of our Services who wish to connect with potential Influencers (“Customers”). We collect different types of information on the various people involved, which is detailed below.
Our Sites are not directed to children and we will not request Personal Information from anyone who we know to be under the age of 18, unless we have obtained verifiable parental consent from a parent or legal guardian. If we become aware that a user under the age of 18 has provided personally identifiable information, and we have not obtained prior verifiable consent from a parent or legal guardian, we will immediately remove the child’s Personal Information from our files.
Types of Information We Collect from Customers
We collect different types of information, either directly from you at signup or during your use of the Services, or indirectly from your device. We collect only the information that is strictly necessary for us to provide you with our Services. We collect both your Personal Information (such as your name, email address, mailing address, phone number, and job title and other pieces of information that could be used to personally identify you) and Aggregated Information, which can’t be used to personally identify you.
It is necessary for us to collect your Personal Information in order to provide to you the Services. We collect and use the following types of information for the following reasons. All information is voluntarily provided by you when the various forms in our Services are filled out. You are free to withhold your Personal Information at any time, but this may prevent us from providing the Services to you as intended.
Fourstarzz also collects aggregate information, which is non-personally identifiable information about you, such as frequency of visits to the Site, browser type, etc. Aggregate information is used in a collective manner, and no single person can be identified by that compiled information. Fourstarzz uses aggregate information to provide its services and remuneration, as well as to determine the use of our Site and to monitor, audit and analyze information pertaining to our business metrics.
Sharing, Selling and Trading of Your Personal Information Collected Online with Third Parties
In the following circumstances, Fourstarzz may elect to share or transfer your Personal Information to unrelated third parties: (i) to comply with a legal requirement, judicial proceeding, court order, or legal process served on Fourstarzz, (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Fourstarzz; (iv) when we believe it is necessary to protect the rights, property, or safety of Fourstarzz or other persons, or (v) as otherwise required or permitted by law.
Sharing, Selling and Trading Aggregate Information Collected Online with Third Parties
We may share, sell or trade with third parties aggregated, non-Personal Information, for example, how many users clicked on a particular button. As stated earlier, such information does not identify you individually.
Types of Information We Collect about Influencers
Influencers are active social media participants with whom Customers can partner to increase awareness of their product or services. We connect Influencers with Customers and therefore must collect a reasonable amount of information about Influencers. Generally, we obtain relevant data from Influencer Networks, which obtain relevant data from the social media presence of Influencers on Instagram, Facebook, Twitter, YouTube or Google Analytics via its API, which is subject to the Platforms Policies. The information that is collected about the Influencer is widely and publicly available on the various social media platforms and has been voluntarily shared by the Influencer themselves. Details on our collection of this information is below:
In order to provide the Services to our Customers, we collect a vast amount of information about the individuals who follow the Influencers and can be influenced by them (the “Audience”) in order to provide Customers with statistics. This often includes, in particular: gender, age group and ethnicity on an aggregated basis. While these items may represent a somewhat sensitive issue, we have undertaken a review of our legitimate interests and the risks to the rights of individuals in information about them that does not individually identify them. Our processing for statistical purposes does not affect the rights and freedoms of individuals and complies with relevant legislation. We do not use the information we collect to discriminate against any group and collect the information purely for statistical purposes in accordance with our valid business purposes.
Sharing, Selling and Trading Information About Influencers and their Audiences
We provide an influencer matching service and so, the data about Influencers identified above is shared with Customers whether on a trial basis or upon payment of fees. Data about the Influencer’s audience is aggregated for statistical purposes and shared with Customers as we provide our Services. To allow Customers to choose an Influencer for their business purposes and assess the effectiveness of each Influencer’s reach, we provide estimates to the Customer on the pricing for an Influencer (if provided from the Influencer Networks).
Storage and Protection of Personal Information
Fourstarzz collects and uses Personal Information only for the purposes for which it was collected and in accordance with this Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the Personal Information needed to provide or improve our services. We take reasonable steps to ensure that the Personal Information we process is accurate, complete, and current, but we depend on our users to update or correct their Personal Information whenever necessary.
We store the data of our Customers [and Users] while your account is active. We will delete your personal data from our system 1 month from expiration of subscription or free trial or when you exercise your rights (as laid below). Information about Influencers and their Audiences that is collected by Influencer Networks and provided to us is kept by us to the extent that it remains under the control of the Influencer Network. If the data is deleted off of the of the Influencer Network, it will be deleted from our control when the two collections synchronize (can be up to a month). If we collect the information directly, we will store and maintain the information no longer than it takes to engage in our lawful business activities. We will also delete your information if you choose to exercise your rights (as laid out below).
Regardless of the type of information, we take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage, and processing practices, and introducing security measures, including physical security measures, to guard against unauthorized access to systems where we store personal data.
We restrict access to Personal Information to Fourstarzz employees, service providers and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security. IN NO EVENT WILL FOURSTARZZ OR ITS SUBSIDIARIES, AFFILIATES OR ANY PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITE BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS, USE OR INABILITY TO USE THE SITES, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE (INCLUDING LOSS PROFITS, LOSS OF BUSINESS OR DATA, BUSINESS INTERRUPTION, AND DAMAGES THAT RESULT FROM INACCURACY OF THE INFORMATION OR INCONVENIENCE, DELAY, OR LOSS OF THE USE OF THE SITES). THE FOREGOING LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF FOURSTARZZ OR ITS AFFILIATES OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Your Rights to Your Personal Information
We are fully committed to respecting your rights and wishes as they pertain to your Personal Information, including by complying with relevant data privacy laws and regulations as detailed below. We constantly weigh our business needs and your legitimate privacy interests and do not engage in business activities in which your interests outweigh ours. You are also entitled to impose restrictions or limitations on the collection of your information or its processing. As required by the GDPR, we require that all processors and subprocessors of the data we collect fully comply with the obligations of the GDPR and do not infringe on your privacy rights in any way.
Automatic Data Collection Policies
Our Site is not designed to respond to “do not track” signals received from browsers.
A pixel tag, also known as a clear GIF or web beacon, is an invisible tag placed on certain pages of our Site but not on your computer. When you access these pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. If you turn off cookies, the pixel tag will simply detect an anonymous website visit.
Associated Transfers of Personal Information
Your Personal Information may be processed, used, stored, or accessed in the United States or other countries where we have operations, and may be subject to the laws of those countries including requirements to disclose information to government authorities, courts or law enforcement agencies.
In the event that Fourstarzz sells substantially all of its assets, or is acquired, personally identifiable information of visitors to the Site and aggregate information will likely be one of the transferred assets.
Copyright Infringement/DMCA Notice
If you are a copyright owner or an agent thereof and believe that any content on the Site infringes upon your copyrights, you may submit a notification pursuant to Title 17, United States Code, Section 512(c)(3), the Digital Millennium Copyright Act (“DMCA”) by providing us with the following information in writing:
